Umbrella liability for significant wealth

How exposed are you?

A lawsuit doesn't look at the number on a policy. It looks at what can be collected: homes, accounts, business interests, and years of future income. These tools show what may be within reach of a judgment, and where an umbrella program often falls short.

The basics

What an umbrella policy actually does

A personal umbrella sits on top of the liability coverage in home, auto, and watercraft policies. When a covered claim is larger than those underlying limits, the umbrella pays the excess, up to its own limit. Many umbrellas also cover some claims the underlying policies don't, such as libel or slander, usually after a self-insured retention.

The structure matters as much as the limit. An umbrella generally expects specific underlying policies to stay in force at specific limits. If one lapses, is set too low, or never listed a home, a car, a boat, or the trust that owns them, the umbrella may pay far less than expected, or nothing.

Layer 1

Underlying policies

Home, auto, watercraft, and any other liability policies respond first, up to their own limits.

Layer 2

The umbrella

Pays above those limits for covered claims, and may cover certain claims the underlying policies exclude.

What's left

Personal assets and income

Anything above the umbrella limit, or outside its coverage, can fall on the family's own balance sheet.

Where programs break

Common umbrella gaps

Most gaps aren't about the size of the limit. They come from how assets are owned, who is driving, and what changed since the policy was written.

01

Trusts and LLCs not named

Homes, vehicles, and boats titled to a trust or LLC may need that entity named on both the underlying policy and the umbrella.

02

Watercraft and larger boats

Umbrellas often limit boats by length or horsepower, or require the boat's liability to be scheduled underneath at a set limit.

03

Household employees

Nannies, house managers, drivers, and caretakers raise questions about injury and employment claims an umbrella may not cover.

04

Teen and young drivers

New drivers are a frequent source of serious claims. Every household driver should be listed and every vehicle scheduled.

05

Board service and nonprofit D&O

Personal umbrellas commonly exclude or limit directors and officers liability. Nonprofit board seats deserve their own look.

06

Rental property

Rental homes, short-term rentals, and properties held in an LLC may fall outside the umbrella unless they're scheduled.

07

Underlying lapses and mismatched limits

If an underlying policy lapses, is cancelled during a renovation, or carries less than the umbrella requires, the family can be left to cover the difference.

08

Social media and libel

Personal injury coverage for libel, slander, and invasion of privacy varies widely. Online posts and public roles make it worth confirming.

09

Excess UM/UIM

Uninsured and underinsured motorist coverage protects the family when the other driver can't pay. Many umbrellas offer it only as an option.

Tool 1

Exposed assets and future earnings

A rough look at what could be within reach of a large judgment, compared with the current umbrella limit. The sample numbers are placeholders, so replace them with your own. Nothing typed here leaves this page.

Answer each question honestly. "Not sure" counts the same as "No" until it's confirmed, because an unknown is still a gap. Choose N/A where an item doesn't apply to your household.
